24.29.213 PROCEDURE FOR ISSUING WORKERS' COMPENSATION DETERMINATIONS REGARDING EMPLOYMENT STATUS, INCLUDING THAT OF INDEPENDENT CONTRACTOR (1) Disputes regarding the employment status of an individual for workers' compensation purposes, including whether that individual is acting as an independent contractor, are regulated by the provisions contained in ARM Title 24, chapter 35, subchapters 2 and 3. (2) The test for determining whether an individual is acting as an independent contractor for workers' compensation purposes is that found at ARM 24.35.301 through 24.35.303. (3) Notwithstanding the provisions of ARM 24.29.213(1) , an individual may apply to the department for an exemption from the Workers' Compensation Act pursuant to the provisions contained in ARM Title 24, chapter 35, subchapter 1.
