17.24.327 COAL PROCESSING PLANTS AND SUPPORT FACILITIES NOT LOCATED WITHIN A MINE PERMIT AREA: SPECIAL APPLICATION REQUIREMENTS
(1) This rule applies to any person who intends
to operate a coal preparation plant, processing plant or support facility not
located within a permit area of a specific mine. Any person who intends to
operate such a processing plant or support facility shall obtain a permit from
the department in accordance with the requirements of this subchapter.
(2) Any application for a permit for operations
covered by this rule must contain in the mining and reclamation plan, specific
plans, including descriptions, maps, and cross-sections of the construction,
operation, maintenance, and removal of the preparation plant, processing plant
and associated support facility. The
plan must demonstrate that those operations will be conducted in compliance
with all applicable rules.
