36.25.320 RECORDS
(1) The board
shall keep a record of all of its meetings in the form of minutes of such
meetings, reflecting all matters considered by the board, decisions made and
actions taken with respect to the leasing or possible leasing of state lands
for coal. Such minutes shall be open to public inspection during normal office
hours of the department.
With respect to any hearing held by the board on application of any affected lessee,
the minutes shall show only that such hearing was held, the nature of the
hearing, and the decision reached by the board.
(2) A separate file and record shall be kept on each hearing held on application of
a lessee or prospective lessee. Such separate file shall contain the written
application for the hearing, a copy of the notice of the hearing, evidence of
the mailing thereof, and the transcript of the hearing, if prepared.
(3) The
department shall maintain a record of publication of notices of all lease
sales. Such record shall consist of published copies of such notices or
affidavits by each printer or publisher of the newspaper or his foreman or
principal clerk, annexed to a copy of the document or notice. The record shall
specify the times when and the paper in which the publication was made.
