NOTICE OF AMENDMENT

 

TO: All Concerned Persons

 

1. On September 23, 2022, the Department of Agriculture published MAR Notice No. 4-22-276 pertaining to the public hearing on the proposed amendment of the above-stated rule at page 1786 of the 2022 Montana Administrative Register, Issue Number 18.

 

2. The department has amended ARM 4.9.401 as proposed.

 

3.  The department intends to apply the rule amendment retroactively to January 1, 2023.  A retroactive application of the rule amendment does not result in a negative impact to any affected party.

 

4. The department has thoroughly considered the comments and testimony received. A summary of the comments received, and the department's responses are as follows:

 

There were six comments all in support of the increase or even a greater increase.  Based on those comments, the department is comfortable adopting the fee increase as originally proposed.
