CORRECTED NOTICE OF AMENDMENT

 

TO: All Concerned Persons

 

1. On August 4, 2023, the Alternative Health Care Board (board) published MAR Notice No. 24-111-29, which included the proposed amendment of the above-stated rule, at page 738 of the 2023 Montana Administrative Register, Issue Number 15. On September 22, 2023, the board published the notice of amendment, amendment and transfer, transfer, adoption, and repeal at page 1093 of the 2023 Montana Administrative Register, Issue Number 18.

 

2. On June 23, 2023, the board published MAR Notice No. 24-111-28, which also included a proposed amendment of the above-stated rule, at page 542 of the 2023 Montana Administrative Register, Issue Number 12. On August 25, 2023, the board published the notice of amendment at page 886 of the 2023 Montana Administrative Register, Issue Number 16.

 

3. A rule number was incorrectly referenced in ARM 24.111.2301(1) as the result of the adoption of the proposed amendments in MAR Notice No. 24-111-28.  The rule, as amended in corrected form, reads as follows, deleted matter interlined, new matter underlined:

 

            24.111.2301 UNPROFESSIONAL CONDUCT (1) It is unprofessional conduct for a licensee or applicant to violate any statute, rule, or standard of care governing their scope of practice. In addition, the following is unprofessional conduct:

            (a) through (g) remain as adopted.

            (h) failure by a midwife to maintain current and valid certifications in adult and infant cardiopulmonary resuscitation and neonatal resuscitation as provided by 37-27-201, MCA.;

            (n)(i) prescribing a scheduled drug without a current DEA registration.
