NOTICE OF REPEAL OF EMERGENCY RULES

 

          TO: All Concerned Persons

 

1. On December 1, 2016, the department adopted the above-stated emergency rules that were subsequently noticed and published on page 2414 of the 2016 Montana Administrative Register, Issue Number 24.  On November 30, 2016, Governor Bullock issued Executive Order No. 18-2016 proclaiming an invasive species emergency.  The executive order stated invasive aquatic species comprised a grave threat to the waters and economic resources within the state of Montana, and such introduced species are best controlled when experts take management measures quickly after their introduction is discovered.  In the executive order, Governor Bullock developed an incident management organization to manage the state of Montana's response to this invasive species emergency.  The incident management organization requested an immediate temporary emergency closure for Tiber Reservoir and Canyon Ferry Reservoir in order to limit the launch or removal of any boat, dock, or other structure that could potentially transport invasive aquatic mussels.

 

2. The rules were to be in place until ice over, and the incident management organization has made the decision that this condition has been met. The repeal of the rules will be sent as a press release to newspapers throughout the state and posted on the department's web site at fwp.mt.gov. Also, signs informing the public of the closure will be removed at access points. The repeal notice will be sent to interested parties, and published in Issue Number 2 of the 2017 Montana Administrative Register.

 

3. The repeal of the emergency rules is effective January 10, 2017.
