(1) Pursuant to 13-37-240, MCA, the term "direct or indirect benefit" means the distribution of surplus campaign funds that benefit only the candidate or a member of the candidate's immediate family. Nothing in this rule prohibits the distribution of surplus campaign funds to a group of individuals or an organization to which the candidate or a member of the candidate's immediate family belongs, as long as the candidate or a member of the candidate's immediate family do not control how the group or organization spends the surplus campaign funds received by the group or organization, and the candidate or a member of the candidate's immediate family receive a benefit that is only incidental to their membership or participation within the group or organization.
