(1) The department will review each submitted
application to insure that it is completed.
If additional information is required, the department will notify the
applicant in writing and will postpone processing the application until the
additional information requested is received and the application is
complete. If the requested additional
information is not received within 90 days after the applicant has been
notified, a new application must be submitted.
(2) Within 15 days after receipt of the completed
application, the department shall notify in writing the local health officer in
the county where the proposed solid waste management system will be
located. The department shall review
the completed application and other relevant information and make a proposed
decision based on the applicant's apparent ability to comply with the act and
this subchapter.
(3) A public notice will then be prepared by the
department to explain its proposed decision.
It shall be circulated in the following manner: one copy to the
applicant, and 3 copies shall be mailed to the public health officer along with
instructions that they be posted at the nearest post office and 2 other public
buildings serving the geographical area of the proposed system. At least 1 news release shall be prepared
and sent by the department to an area newspaper.
(4) The purpose of the public notice is to inform
the public and seek their views on the proposed license. The notice shall state the name and address
of the applicant, the proposed location of the solid waste management facility,
and the department's proposed decision.
The public shall be informed that it has 30 days from the date of the
public notice to submit written comments to the department concerning the
license application. Interested persons
may obtain copies of the completed application and the department's proposed
decision, upon request, by enclosing the copying costs.
(5) After the comment period has expired, the
department will make its final decision and then notify in writing the local
health officer, the applicant and any other interested persons who have
requested to be notified. If the
department decides to issue the license, the local health officer has up to 15
days within which to validate the license with his signature. If he refuses to
validate the license, he must notify the department, the applicant and any
other interested persons in writing.
His decision must be based only on whether the application complies with
the act and this subchapter.
