(1) In addition to the exclusions stated in ARM
17.30.1310, the following storm water discharges do not require MPDES permits:
(a) point source discharges
of storm water to ground water as provided in 75-5-401(5) (g) , MCA;
(b) existing or new
discharges composed entirely of storm water from oil or gas exploration,
production, processing, or treatment operations, or transmission facilities,
unless the operation or facility:
(i) has had, at any time
since November 16, 1987, a discharge of storm water resulting in the discharge
of a reportable quantity for which notification is or was required pursuant to
40 CFR 110.6, 40 CFR 117.21 or 40 CFR 302.6;
(ii) contributes to a
violation of a water quality standard; or
(iii) has a storm water
discharge associated with construction activity, as defined in this subchapter;
(c) existing or new
discharges composed entirely of storm water from mining operations, unless the
discharge has come into contact with any overburden, raw material, intermediate
products, finished products, byproducts or waste products located on the site
of such operations.
