(1) A peace officer hired after the effective date of this
regulation must:
(a) meet the minimum employment, education and
certification standards as promulgated by the board of crime control and as
required by 7-32-303, MCA;
(b) attest that he subscribes to the law
enforcement code of ethics;
(c) be eligible for the award of certificate, be a
full-time, or part-time, paid and sworn peace officer employed by a law
enforcement agency as defined by the board of crime control; and
(d) have completed the designated combinations of
education, training and experience as computed by the point system established
by the POST advisory council.
(2) A peace officer already serving under a
permanent appointment prior to the effective date of this regulation shall not
be required to meet any of the requirements for certification as a condition of
tenure or continued employment; nor shall failure to fulfill such requirements
make him ineligible for any promotional examination or consideration for
promotion for which he otherwise would be eligible.
(3) A reserve officer, as defined in 7-32-201(5) ,
MCA, is neither required to obtain nor eligible for a basic certificate.
