17.30.102 DEFINITIONS
In this subchapter the following terms have the meanings
indicated below and are supplemental to the definitions in 75-5-103, MCA:
(1) "Applicant" means a person who
applies for a license or permit issued by an agency of the federal government
to conduct an activity that may result in discharge into state waters.
(2) "Licensing or permitting agency"
means an agency of the federal government to which application is made for a
license or permit to conduct an activity which may result in a discharge into
state waters.
(3) "Regional administrator" means the
administrator of Region VIII of the US environmental protection agency.
(4) "Discharge" means the injection,
deposit, dumping, spilling, leaking, placing, or failure to remove, of any
pollutant so that it or any constituent of the pollutant may enter into state
waters.
