NOTICE OF AMENDMENT

 

TO:  All Concerned Persons

 

1.  On March 11, 2010, the department published MAR Notice No. 2-21-427 regarding the proposed amendment of the above-stated rules at page 590 of the 2010 Montana Administrative Register, Issue No. 5.

 

2.  The department has thoroughly considered the comment received.  A summary of the comment received and the department's response follows:

 

COMMENT #1:  The department received a suggestion to distinguish and separate the Incentive Award Program to designate one program for the citizens of Montana and one program for employees working within state government.

 

RESPONSE #1:  The department did not make this change.  The department is charged to create an employee incentive program in accordance with 2-18-1102, MCA.  The eligibility for the award is contained in 2-18-1105, MCA, which states, "an employee, a group or team of employees, or a nonemployee is eligible for an incentive award."

 

3. The department has amended ARM 2.21.6702, 2.21.6703, 2.21.6708, and 2.21.6709 exactly as proposed.
